Formula & Calculation Methodology

Late Fee = Min(Cap, Days × Rate per day); Section 50 Interest = Net Tax Payable × (18% ÷ 365) × Days Delayed.

Step-by-Step Worked Example

Regular Return | 25 Days Delayed | Net Tax Payable: ₹25,000

  1. Late Fee (25 Days @ ₹50/day) = ₹1,250 (₹625 CGST + ₹625 SGST)
  2. Section 50 Interest = ₹25,000 × (0.18 ÷ 365) × 25 = ₹308
  3. Total Statutory Liability = ₹1,250 + ₹308 = ₹1,558
Result: Late Fee: ₹1,250 | Interest: ₹308 | Total Liability: ₹1,558

Statutory GST Late Fee Limits

Under the GST amnesty framework, regular return late fee is ₹50 per day (₹25 CGST + ₹25 SGST, capped at ₹5,000 per return). For Nil returns with zero tax liability, late fee is ₹20 per day (capped at ₹500).
